There are the following types of orders that can be placed at Hobby Search. |

Already released:
|
|

You can purchase the already released, in-stock items.
(a portion of the products are not stocked in our warehouse, and we may need to backorder these from our suppliers/manufacturers. In such case, we may be required to cancel the order, if the suppliers or manufacturer does not have any in their stock. Please also understand that popular items may run out of stock while you process your order.)

Pre-order:

|
|
You can reserve items before their release date.
You can obtain items that are likely to become unavailable after they are released (on rare occasion, the suppliers may reduce our ordered quantity for popular items, and we may not be able to provide you the product in such case. Also, please understand that production of items may be cancelled by the manufacturer if the amount of order does not meet their requirements, in which case your order will be cancelled.)

For some of the items that are sold out, we set a "Notify when available" function for customers to use. If you register your email address to the list, we will let you know by email when we stock the item or when it is ready for reservation. This is not an actual order, so you will need to place an order separately if you wish to purchase or reserve the product.

We will only process order and reservation placed through the shopping cart on our website. Please understand that we are unable to accept orders by telephone or FAX.

You will also be able to reserve or order multiple items at one time. We will be able to ship the items in the same shopping cart as one shipment, only if the items are already in-stock. Reserved items may be shipped in multiple packages, depending on the shipping arrangement and the release date. Please refer to 26 to 29 (Combined shipment / Order Recombination) for finer details.

We offer shipment by the following methods:

EMS: Fast, safe and reliable shipping method. Often complete delivery within a week(*1) with minimum delivery time of 3 days. Also have tracking number and insurance of up to 20,000yen for damages or losses during shipment. ( *1 Varies for destination, please check the Japan Post website for more information)

SAL Small Packet: Slow but economical shipping method. Only available for small packages with size and weight limitations. No insurance offered for any damages or losses to the order during shipment by this method, and has no tracking number.
|

(3) |
Registered SAL: Slow but economical shipping method. Only available for small packages with size and weight limitations. Also have tracking number and insurance of up to 6,000yen for damages or losses during shipment.
|
|
(4) |
SAL Parcel: Slower than EMS, delivery usually takes 2 to 3 weeks for most locations. Also have tracking number and insurance of over 10,000yen*1 for damages or losses during shipment. ( *1 depends on weight of package, please check the Japan Post website for more information)

(5) |
ePacket Light: Slow but economical shipping method. Only available for small packages with size and weight limitations, treated as SAL class shipment.
Tracking is available, but no insurance offered for any damages or losses to the order during shipment by this method.
Signature is not required on acceptance of the package, so the package may be delivered to post box etc. if they fit.

Shipping cost will depend on the weight of product, shipping destination, and method of shipment used, so please refer to the shipping cost chart linked below to check the shipping cost rate(*2).

Orders will generally be shipped per shopping cart. We cannot ship already released items with reserved items. We also cannot ship an order with another order placed earlier. Please see 26 to 29 (Combined shipment / Order Recombination) for more details.

For multiple pre-order items, you will have the following shipping arrangements:

Ship on Release: We will not hold your item, and will ship your item as they come into stock. If items included in one order have different release dates, we will ship them separately as they come into stock.

(2) |
Monthly Shipment/Order No.: If the order includes multiple pre-order items, we will hold the shipment of these items until the end of the month of its release, and will ship the items that are released at the beginning of the following month.

We will proceed with shipment once all the items in an order come into stock, even if this is before the end of the month.
|
|
|
* |
Only items under the same order number and same release month will be shipped together. However, you can process "Order Recombination" after you place your order and combine shipment of items with the same release month.

Already released items and preordered items cannot be shipped together, even if they have the same order number. However, if there are pre-ordered items that are already stocked and waiting for other items in the same order to come into stock, this can be recombined with an order for already released item during its cancellation period.

In cases of obvious manufacturing defect on arrival:

Please contact us within a week from the arrival of your order, with explanation of the situation and also include photos of the problem where possible, so that we can better understand the situation and deal with your problem.

In case of problem during delivery:

If you receive your order damaged and there is evidence of shipment damages, please contact the delivering company, and also contact us if you need our assistance. We generally cannot compensate for damages or losses caused during shipment, as we entrust delivery of orders to the shipping company.

If the item you received was not what you had ordered (e.g. different variation or completely different product), please contact us within a week after arrival of your order. We will discuss the details with an email in reply.

We generally do not accept return or exchange of products at the convenience of the customer, especially for reasons such as products not being exactly as the customer imagined for it to be etc.

Cancellation by the customer can only be processed while the "Cancel" button is available next to their order on the "My Account" page, which is during the "Cancellation Period". If the "Cancel" button is unavailable, this means the cancellation period had ended.
Cancellation period for orders are as follows:

Orders placed between 00:00AM to 08:30AM can be cancelled until 08:30AM the same day.
Orders placed between 08:31AM to 11:59PM can be cancelled until 08:30AM of the following business day. (Times listed in Japan time, GMT+9)

Cancellation of Reserved Items
|
|
|
|
Preorders can be cancelled until up to one week from the time the order was placed.
For products marked "Cannot be cancelled" and passed "Order deadline" cannot be cancelled regardless of the cancellation period.

Even if the cancel button is unavailable, cancellations may be accepted for the following exceptions.
|

If there is a duplicated order or mistake in quantity, please contact us before business operates on the following business day.
|
|
(2) |
If "Notify of stockout by e-mail" option for shipping arrangement had been selected, and you receive a notice of stock shortage.
|
|
(3) |
If the price of the product had been changed greatly since the placement of your pre-order
(Change in currency exchange rate will not be considered as change in product cost).

We may make other special exceptions to accept cancellations outside the cancellation period if the customer contacts us with situation we deem inevitable, although we may be required to charge a cancellation fee.

If we are unable to obtain the ordered item due to circumstances such as stock shortage, we will be required to cancel the order.
|

For cases where there are multiple items in an order and a portion of the order is out of stock, we will cancel the out of stock items if the "Just ship available items" option had been selected for the shipping arrangement.
We may notify you of the stock shortage at our decision, but we do not send these notifications in general.
|

For cases where there are multiple items in an order and a portion of the order is out of stock, we will notify the customer of the stock shortage by e-mail if the "Notify of stockout by e-mail" option had been selected for the shipping arrangement. In such case, we will be discussing the options with the customer, and the customer will have opportunity to cancel their order at this point.

However, the "Notify of stockout by e-mail" option may cause delay in shipment of items, as your order will require processing manually and communication may take time.
|

If "PayPal Express Checkout" had been selected for payment option, and we are unable to confirm the payment within the specified payment period notified in the payment request email, we may be required to cancel your order.

We will also be required to cancel orders if payment is not completed during the payment period, in cases where authorization or processing of payment had failed for "Credit Card" payment or "PayPal Pre-Approved Payment".

We may be required to cancel all ordered items and end our business with a customer for the following cases:

If we are unable to communicate with the customer, or if
|
|
- |
the customer does not follow our terms and conditions, or if
|
|
- |
the customer cause cancellations outside our cancellation policy, or if
|
|
- |
there are other reasons we believe the customer is unfit to continue business with.

(Combined shipment / Order Recombination) |

For reserved items, only items that are in the same shopping cart with the same release month can be shipped together. However, the "Order Recombination" function will allow you to select items that have the same release month from multiple shopping carts to combine their shipment.

"Already-released" items and "pre-ordered" items cannot be shipped together, even if they are in the same cart.
|

Already released items cannot be recombined. However, if you have multiple in-stock orders when we process your order to prepare for shipment, we may choose to combine shipment as we find appropriate. Please note that there is possibility that we may not be able to combine shipment even if the orders are processed on the same day, if the timing of order processing does not match, so we cannot guarantee combined shipment. Also, if the payment or shipping method does not match for the orders to be combined, we will select the shipping and payment methods as we find appropriate.

Other points of consideration for Order Recombination

You cannot reverse the effect of order recombination once an order is recombined. |
|
- |
After the order recombination is completed, we will notify the customer of the details of the recombined order by email.
|
|
- |
If you recombine the pre-ordered items, "Monthly Shipment/ Order No." will be selected for the shipping arrangement.
|
|
- |
When you process order recombination, the order information (such as shipping details and payment methods) of your most recently ordered item in the selected items will be used as the combined order.
|
|
- |
You cannot process order recombination of already released item with another already released item. We will generally try to combine orders placed by SAL Small Packets or Registered SAL Small Packet together where possible, depending on the total size of the order. For orders placed with EMS shipping, we generally will not combine these unless requested by the customer.
|
|
- |
If there is a price change of a product after the order is placed, the latest price will be reflected for the new order if you process order recombination.
|

(About Products we deal) |

Products sold at Hobby Search are generally aimed for the Japanese customers, so instructions and descriptions etc. will be in Japanese language and electric current or other specifications will also be made to match the Japanese market.

(About adult products) |

Customers under the age of 18 cannot purchase adult products.
|

For adult products with age restriction for purchase, we display precaution for sales of adult products on the order form in which the customer must agree in order to proceed with their purchase.

If a customer purchases an adult item while falsely declaring his/her age, we may suspend his/her account or confiscate their points. Also, we cannot be held accountable if there are any losses caused due to a customer falsely declaring his/her age.

Before purchasing adult products, customers must check the law of their residing country to make sure it is legal for you to purchase the item. Purchase of adult product is solely the responsibility of the customer and we will not be held responsible in case of any conflict caused by your purchase of adult goods.

Membership registration is required to use this site. Hobby Search membership provides the following services:

The customer will be awarded points that can be redeemed on this site, when they complete a purchase at Hobby Search. Points can be applied to the customer's following orders to discount on the product cost.

(2) |
Save re-entering of information such as name and address.
|
|
(3) |
The customer will have access to the account page, in which they can manage their pending orders and reservations. The account page offers the customer ability to combine reservations that are scheduled to be released in the same month, which may lead to saving on shipping cost.
|
|
(4) |
The customer will also be able to change order details such as shipping and payment options as long as the changes are processed before the order enters the "preparing for shipment" stage.
|

Membership registration is free of charge, and there is no annual or monthly fee.
|

|
|
|
(About points) |

Hobby Search points are only valid on this website.
|

1 point is equivalent to 1 yen (JPY) and can be used to receive discount on the product cost of an order.

On purchase of products at Hobby Search, 1% of the purchased product cost will be awarded as points.

Points will be added to the customer's account AFTER the order is dispatched from Hobby Search.

The points are valid for up to 1 year from the date that the customer had last been awarded Hobby Search Points to their account, unless expiry is otherwise specified (such as rewards for giveaway campaign etc.)

Points from different accounts cannot be transferred, and cannot be converted to cash.

Hobby Search Membership
This terms and conditions applies to the entire relationship between Hobby Search Co., Ltd. (hereinafter referred to as "we" or "us") and all the customers who use this service (hereinafter referred to as "members") when members use any of our service intended for the customers to use (hereinafter referred to as "this service") provided on "Hobby Search" (hereinafter referred to as "this site"). By registering to the Hobby Search Membership, through filling necessary information on either the order form or the membership registration form on this site and submit their form, we will regard the customer to have understood and agreed with all terms and conditions included in this "Membership Terms and Conditions".
Chapter 1: Membership

Article 1: Definition of Member and Membership Registration |

A person who wishes to register to this service (hereinafter referred to as "applicants") must accept with this Membership Terms and Conditions as well as all articles from "Hobby Search Website Terms of Use" on this site.

Applicants must follow application procedure according to the form provided on this site. Further, applicants must enter only true information when registering.

Applicant who followed the application procedure in the preceding clause will be recognized as a formal member, from the moment we approve the application.

We may decline the registration if the applicant corresponds to any of the following clause. We may terminate relevant membership even after the approval of the membership registration in such case.

If the applicant does not correspond to the first clause of Article 1.
|
|
(2) |
If the applicant is already a member of this site, or is suspected of this.
|
|
(3) |
If applicant had caused non-payment, cancellation, return of the item, or refusal of acceptance of packages etc. in the past.

(4) |
If the applicant had received punishment of any form from us in the past.
|
|
(5) |
If there is false information, error, or lack of information in the content of registration.
|
|
(6) |
If the applicant does not follow our instruction during the application procedure.
|
|
(7) |
If there are any other reasons in which we judge the applicant to be unsuitable as a member.

|
|
Article 2: Hobby Search ID/Password |

We issue Hobby Search ID and password (hereinafter referred to as "login info") to the members of this site, which the member had chosen when registering.

Members must handle and manage their login info securely.
|
3 |
The member will only be identified as themselves if the login info entered for the corresponding usage matches that of the member's registered login info from the earlier clause.
|
4 |
Members must take responsibility for any mismanagement of their login info, or negligence on usage of login information, and are obliged to compensate for any damages or losses caused in such cases.
|
5 |
Members must contact us immediately if they lose their login info or if they noticed that their login info is used by a third party. Further, the said member will process the reissuing of login info under our guidance.
|
6 |
We cannot be held liable for any losses caused by the member's failure to contact us in the preceding clause.
|
7 |
Members are obliged to compensate us or the third party for any losses caused by the member's failure to contact us in the 5th clause.
|
|
|
|
|
Article 3: Prohibition for Transfer of Rights |

Members are prohibited to allow use of their login info to a third party, or to lend, give, alter name, purchase and sell, or pawn their login info to a third party.

2 |
Members are prohibited to allow use of full or partial rights of that member established on this Membership Terms and Conditions, or transfer, sell, alter name, or pawn their full or partial right.
|
3 |
We cannot take responsibility for any losses to the member, caused by the use of that member's login info by a third party.
|
4 |
Members are obliged to compensate any damage to us or to a third party, caused by the use of that member's login info by a third party.
|
5 |
We will have the right to penalize the member who violated this article by means established on the Article 14.
|

Article 4: Change and Modification of Registered Information |

Members must update their registered information immediately from their account page, when there is a change in their registered information due to marriage, change of address, or any other reason.

2 |
The change and modification of the registered information mentioned in the preceding clause must be processed by the member themselves.
|
3 |
We cannot be held liable for any losses to members, caused by the negligence of that Member to change or modify their registered information on time.
|
4 |
Members are obliged to compensate any losses to us or the third party, caused by the negligence of that Member to change or modify their registered information.
Further, we will have the right to penalize that member by means established on the Article 14.

|
Article 5: Period of Validity and Withdrawal of Membership |

The period of validity for this service will be indefinite, as long as there is no special announcement or request by us or the members.

2 |
Members who wish to withdraw from this service must follow the withdrawal procedure that we specify.
|
3 |
Members who execute the withdrawal procedure are obliged to pay any and all due debt owed to us.
|
4 |
We will not be obliged to return any payments already made by a member that executes the withdrawal procedure.
|
5 |
We will not be held liable for any losses to a member caused by the withdrawal procedure.
|
6 |
Members who execute the withdrawal procedure are obliged to take all legal responsibility for any losses to us or to third party caused by the actions of that member, even after the termination of their membership.

Chapter 2: Regarding This Service

We will not be held liable for any problems regarding Hobby Search Points such as losses or failure of said Points to be awarded to a member, if the problem was caused by that member's negligence of the duty in the preceding clause.

Article 7: Contents of This Service |

|

We have the right to add new service, or edit or terminate this service, without advance notice to the members.

Chapter 3: Hobby Search Point
|
|

Article 8: Definition of Hobby Search Point (hereafter referred to as "HS Point") |
1 |
Conversion rate of HS Point is "1 HS Points = 1 yen" and may be used as store credit on this site.
|
2 |
The HS Point will only be valid within this site.
|
3 |
The HS Point will be valid for one year from the date of your most recent shipment.
|
4 |
The expiry period of HS Points will be extended by one year if the member completes a transaction in which point is awarded, before their accumulated points expire.
|
5 |
If the member does not complete a transaction in which HS Points are generated, within the expiry period of their accumulated points specified in the preceding clause, their points will expire and become invalid.
|
|
|
|
|
Article 9: Acquisition and Usage of Hobby Search Point |

We will award HS Points at the rate specified on a separate chart, to members which use the product sales service (here after referred to as "sales service") of This Service. However, the awarded HS Points will be rounded off, if the HS Point to be awarded is less than 1 point or is a fraction of a point.

The HS Points mentioned in Chapter 3 is to be awarded to the member once shipment of the corresponding order is completed.
|

HS Points can be used when members purchase our product through our sales service.
|
4 |
HS Points are not to be awarded for shipping or and handling fee.
|
5 |
We may set any number of items that awards no HS Points.
|
|
|
|
|
Article 10: Limitations Regarding Hobby Search Points |

We do not accept merging of HS Points, sales, or converting of HS Point to cash, or exchange of HS Points to credit at another shop.
|
2 |
We will not accept any refund of the HS Point already used by the member.
|
3 |
Members cannot buy or sell, convert to cash, or transfer the HS Point they accumulated to a third party. Also, members cannot mortgage the HS Point they accumulated.
|
4 |
Any HS Point that is not acquired through the establish means may be turned invalid at our decision.
|
5 |
We will have the right to execute any penalty specified on Article 14 to the member that obtain HS Points by means we had not established, or the member that gave HS Points to the corresponding member, as well as confiscation of their remaining HS Points and restriction of transaction for that member.
|
6 |
Points accumulated by members that executed the withdrawal procedure, or had their membership terminated by us, will be made invalid along with the termination of their membership, and members are to accept this in advance.
|
Chapter 4: Posting comments and images

Members can post their thoughts and comments about products (hereinafter referred to as "comment / comments") on this site. Further, members are solely responsible for any comments they post.

Members are solely responsible for comments they post, and are obliged to solve any disputes, complaints, or problems caused by that comments, or payout of expenses required in case of lawsuit against the comments etc., and we will be exempted from any responsibility regarding the posting.

Members must not post comments that includes any of the following descriptions. Any comment that violates this will be deleted at our decision.
|

(1) |
The comments may potentially harm or dishonor us, our products, product manufacturer, or the third party.
|
|
(2) |
The comments may potentially interfere with the operation of business or activity for us, the manufacturer of the products, or the third party.
|
|
(3) |
The comment contains expression that is disturbing, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, hateful, or racially, ethnically or otherwise objectionable.

(4) |
The comment is intended to persuade people to commit crime etc.
|
|
(5) |
The comment is intended to persuade people to participate in religion or political organization etc.
|
|
(6) |
The comment is intended to persuade people to use dating service site.
|
|
(7) |
The comments potentially breaches any of the prohibited acts established in Article 13.
|

(8) |
Other expressions that we judge as inappropriate.

Even if the comment does not correspond to the preceding clause, we may delete any comments if any of the following apply.

If the comments may potentially corrupts public moral of this site.
|
|
(2) |
If the comments may potentially causes confusion to other users due to inclusion of false statements etc.

(3) |
If multiple comments are made by the same ID or user that we judge as malicious.
|
|
(4) |
If members intentionally use multiple ID in a deceptive manner, such as sockpuppeting (one user acting as multiple members by using multiple IDs).
|

(5) |
If content of the comments is possibly ciphered or can only be understood by a specific group and we judge as inappropriate for operation of this site.
|
|
(6) |
If the comment is in a language in which most members are unable to understand, or possibly find unpleasant that we judge inappropriate.
|
|
(7) |
Other postings that we judge are against the aim of this site or this service.
|

If a member finds a comment that is likely to be against either the 3rd or 4th clause of this article, they can report that comment for us to consider removal of that comment.

We will have the right to penalize users by means established in the Article 14, if that user repeatedly posts comments etc. that is against the 13th Article, or 3rd or 4th clause of this article, or the member that post comments etc. that we judge inappropriate.

Article 12: Secondary Use of Postings |

We will have the right to publish the comments by members on our newsletters and other sites, as well as to provide this to publishing companies without prior notice, for the purpose of improvement of sales for this site.
We regard the members to have understood and agreed with the above statement in advance. Further, the above is also true for the purpose of promotion and operation, to assist product manufacturers and suppliers we are partnered with.

Members are to agree and permit us to use the corresponding comment in cases where we decide to publish or provide this as specified in the preceding clause, for indefinite period without fee, and cannot execute copyright privileges for the said comment.

Chapter 5: Prohibition and Penalties

Members are prohibited from any of the following acts, when using this site or this service.

To possess multiple Hobby Search ID.
|

To lend or transfer any accumulated HS Point or rights of a member for use of this service, to a third party.

To falsely declare details when sending information.
|

Other action that we judge as inappropriate.

Members will take all legal responsibility for any damages caused to us or the third party, resulted from the action against any of the paragraphs in the preceding clause, even if their membership is already terminated, and we will be exempted from any responsibility for their actions.

|
|
|
Article 14: Penalties |

If the member commit any of the following acts, we will have right to deactivate that member's Hobby Search ID, confiscate their HS Points, and/or terminate their membership without prior notification.
|
|
(1) |
If the member offend any of the acts listed in first clause of the 13th article.
|
|
(2) |
If the member violate this Membership Terms and Conditions, or any terms of use on this site.
|
|
(3) |
If the fulfillment of obligation for any due payment to us are delayed or neglected.
|
|
(4) |
If the member does not follow to our instruction etc. regarding the important issues for usage of this service.
|
|
(5) |
If we judge the member unfit to be our member for any other reasons.
|
2 |
We are not obliged to refund any payments already made by a member who has been subjected to termination of their membership.
|
3 |
We have the right to cancel orders or pre-orders of the members who meet any of the criteria specified in the first clause of this article.
|
4 |
We will not be held responsible for any damages or losses to a member that is caused by the punishment of the first clause of this article.
|
5 |
Members are obliged to compensate for all damages or losses to us or to the third party caused by the action of the said member, even if it is after the termination of their membership.
|
|
|
|
|
Article 15: Forfeiture of Benefit of Time |

Members will forfeit their benefit of time based on this Membership Terms and Conditions, if they fall under any of the followings.
|

If there is a legal motion for a debt consolidation procedures such as application of provisional garnishment, garnishment, application for auction, bankruptcy or allegation of civil rehabilitation proceedings.

|
(2) |
If the member received a reminder of non-payment of tax dues, or there is preservative attachment.
|
|
(3) |
If a credit card that the member specified was stopped or suspended by the credit card company etc.
|
|
(4) |
Other situation where we judge the member's economic situation or credit status had gotten worse or unacceptable.
|

We have the right to execute acts specified in the Article 14, to members that falls under the preceding clause.
|
3 |
If a member is deprived of their membership, they will inevitably lose the benefit of time and must pay all due debt to us immediately.
|
Chapter 6: General Terms

Article 16: Means of Notification |

Our means of notification to members, unless otherwise specified, will be sent through e-mail, message on your account page, posted notification on the website news section in the main pages, or other means that we regard appropriate.

When sending important information or notifications etc. regarding this service, we have the right to send email or News Letters to all members, including those that had set their email settings to reject our email notifications, from the moment that the member register to this site.

On transmission of the email to the member's registered email address that the member registered when signing up for membership or updated from their account page etc., we will regard notification by email to be completed.

4 |
Members must update the email reception settings of their computer or mobile phone etc., that corresponds to the email address that member specified when they registered to the membership. They must also permit the reception of our emails sent from us. We will not be held responsible for any damages or losses caused due to failure of that member to update their settings.

Notifications we make through posts on the main pages of the website will be regarded completed, as soon as we post the notification to this site.
|
6 |
As long as there is no formal objection given, we will regard the content of the notification to have been approved by the members on the day we complete that notification.
|
7 |
We will regard the member to have agreed with the notification without objection, if said member had failed to receive our notification due to mistype or error of registered email address, neglected update of their email address or any other reasons caused by the intention or negligence of said member.

Article 17: Management of Personal Information |

We will manage and use the personal information of the members collected through this service, in accordance with the privacy policy of this site. However, absolute prevention of leakage or deletion of personal information or the alteration of said information by a third party will not be guaranteed by us.

We have the right to send information regarding services we offer to members, using the personal information and preferences collected, and we regard the members to have agreed to this in advance.

Article 18: The Relationship between Membership Terms and Conditions and other Terms of Services of this site |

Each Terms of Service or guidelines specified on this site (hereinafter referred to as "Terms of Service") compose a part of the Membership Terms and Conditions to complete this. However, it will not be a case if the Terms of Services contradicts or causes a flaw to the Membership Terms and Conditions.

However, if the alteration of terms requires urgency, we will have the right to post the altered Membership Terms and Conditions on this site and regard notification to be completed, regardless of the preceding clause, and members are to agree to this alteration in advance.

Product Sales
This terms and condition applies to the entire relationship between the consumer of merchandise (hereinafter referred to as "consumer") and Hobby Search Co., Ltd. (hereinafter referred to as "we" or "us"), where the consumers purchase merchandise using our service of sales (hereinafter referred to as "this service") we offer for purchase of various merchandise etc. (hereinafter referred to as "product") at "Hobby Search" (hereinafter referred to as "this site").

Article 1: Sales Price of Product |

The sales price of each product will be the amount that is specified on the corresponding product page of this site.
|
2 |
The currency for the sales price of products will be in Japanese Yen (JPY).
We cannot compensate for any losses caused by the change of currency exchange rates between Japanese Yen and the consumer's local currency or currency used for payment.

3 |
Unless otherwise specified, the sales price of products will be the amount for one unit or one set of that product.
|
4 |
Unless otherwise specified, the prices listed on this site do not include tax.
|

|
|
Article 2: Establishment of Sales Contract |

The contract will be considered agreed upon, and will take effect once the consumer completes an application of purchase, and we send the consumer a notification for acceptance of their application.

The consumer must use our "Shopping Cart" system in order to apply for purchase of products. We will have the right to decline any application of purchase that does not use the Shopping Cart.

3 |
The notification for acceptance of purchase application mentioned in the preceding clause will be sent by email to the consumer's email address, which they had provided during purchase application process. The notice of acceptance will be sent in the form of "Order Confirmation".
However, any incomplete "Order Confirmation" mail will be regarded invalid, and the consumer has the responsibility to check and confirm the content of the "Order Confirmation" email that they receive, and must report to us immediately if there is missing information on the "Order Confirmation" email such as product information for the ordered items etc. which must be included in a "Order Confirmation" email.

The consumers must update their email setting where necessary to allow acceptance of emails from our domain (@1999.co.jp), before processing the purchase application.
|
5 |
In cases where the consumer does not receive a notification for acceptance of purchase application even if they had completed the purchase application process, they must make contact with us before the start of operation for the following business day, counting from the moment the purchase application had been sent.
|
6 |
We will not take any responsibility if a member neglects the obligation specified in the fourth clause or other preceding clause of this article, and suffers loss due to the said nonfulfillment.

|
|
Article 3: Sales Condition |

The consumers must agree to all the articles specified on this Terms and Conditions of Product Sales, as well as that of the "Hobby Search Website Terms of Service" on this site.

We hold the right to deny the conclusion of the sales contract with the consumers who correspond to the following:
|

(1) |
If they do not agree to this Terms and Conditions of Product Sales.
|
|
(2) |
If they do not follow our instructions, or had failed to follow our instructions in past transactions.
|
|
(3) |
If the consumer processed application of purchase without using the Shopping Cart system we provide.
|
|
(4) |
If the consumer had denied acceptance of orders or had left orders unpaid.
|
|
(5) |
If the consumer had caused cancellation or product return that differs to the procedure we specify in the past transaction.
|
|
(6) |
If the consumer had received any sort of penalty from us in the past transaction.
|
|
(7) |
If there are any other reasons we judge the consumer to be unfit as a member.
|
3 |
The consumer is to bear any extra expenses such as shipping and handling fee, tax, payment transaction fee, or any other fees that may arise.
|
4 |
We may collect tax at the point of sale for the countries where we are either obligated or authorized to do so.
|
5 |
We have the right to set purchase requirements, total quantity sold, purchase quantity restriction per consumer etc. for each product, and the consumer is to have agreed with this limitation in advance.
|
6 |
The consumer must keep in mind that there could be possible difference in color, form, size, quality, or other differences that may influence the purchasing decision, caused by the skill of photography, explanation of the product, or margin of error for manufacturing processes etc. and the consumer is to have understood and accept this possible difference in advance.
|
|
|
|
|
Article 4: Points of Consideration for Purchase and Reservations |

The consumers must understand that not all products listed in the product inventory are in our stock, and there is a possibility of stock shortage even if a product is listed on the product inventory.
|
2 |
The consumers must understand that for pre-ordered products, there are possibility of delay in release date, reduction of production quantity, or cancellation of production leading to the product not being stocked etc., due to the convenience of the parties such as the manufacturer or our trading wholesaler etc..
|
3 |
The "Notify when available" function is not an option for purchase or pre-order.
If a consumer wishes to purchase the product, they must place an order separately when the product becomes available.
|
4 |
For products registered with the "Notify when available" function, we do not guarantee if the product will actually be stocked / restocked, or required time for the product be stocked etc.
|
|
|
|
|
Article 5: Payments |
1 |
The consumer is to process payment of orders using the method they had selected among the payment options we offer for that order.
|
2 |
Consumers will pay the purchase cost before shipment of their order, but may be required to pay any additional fee mentioned in the 3rd clause of Article 3 that we do not charge for, when processing payment or on acceptance of package etc. so please check the tax and custom rules of your country and payment provider etc. prior to purchase.
|
3 |
Shipment fee will be machine calculated based on the total product weight included in the order and the weight of packaging material required. However, if there is the change in the total amount due to stock shortage, it will be calculated based on the total weight after the change.
|
4 |
The consumers must obey to our instruction regarding payment of orders.
|
5 |
Consumers must not process any payment by method we do not offer or instruct.
The method of payment we offer is specified on the Payment Option Chart.
|
6 |
We hold the right to execute any number of the following listed acts, to the consumers who do not complete their payment within the payment period of their orders specified on the Payment Option Chart, or those we judge to be refusing payment of their orders:

Cancellation of the sales agreement with said consumer.
|
|
(2) |
Suspension of shipment of orders by said consumer.
|
|
(3) |
Cancellation of the reservation etc. of said consumer.
|
|
(4) |
Restriction of payment method options for future purchases by said consumer.
|
|
(5) |
Refusal of acceptance for future orders by said consumer.
|
|
(6) |
Deprivation of the membership on this site or suspension of said consumer's Hobby Search Account.
|
|
(7) |
Demand or urge payment etc.
|
|
(8) |
Assignment of debt collection to a debt collection agency.
|
|
(9) |
File a lawsuit regarding enforcement of payment duties.
|
7 |
Consumers who processed payment by methods we do not offer, or consumers who did not follow our instruction regarding payment are to take all legal responsibility caused by the said illegal action etc.
|
8 |
Consumers must contact us by email in advance, if they need to delay payment due to inevitable circumstances.
|
|
|
|
|
Article 6: Shipment of products |
1 |
We will ship orders to the shipping address registered by the consumer.
|
2 |
We will generally ship orders using the method the consumer had selected from options we offer. However, if the product exceeds the size/weight limitations etc. for the method of shipment the consumer selected, or if we judge the said method dangerous for shipment of the product, we will use the alternative shipping method we specify.
|
3 |
We will process shipment of orders to consumers after confirmation of payment, as swiftly as possible within reason. However, if the order includes reserved products or multiple products, or if there is a date of shipment agreed upon in advance, this is not the case.
|
4 |
If there is long delay in shipment, we will announce this on our website.
|
5 |
We will regard the order to have been received by the said consumer when we complete the shipment mentioned in the first clause.
|
6 |
We or the delivery company that process the shipment of an order, will not be held responsible if the consumer is unable to receive their order, due to problems such as inaccurate, incorrect, unfilled information etc. or any other error that the consumer is responsible for, in regards to the required information they had provided for delivery of orders, such as address of destination, recipient name, or phone number etc.

We have the right to cancel this Terms and Conditions of Product Sales if the order is returned to us, due to reasons such as absence of the consumer during delivery etc.
|
8 |
We have the right to cancel the Sales Contract if the consumer reject acceptance of the order
|
9 |
Unless otherwise specified, the consumer is to bear any and all fee that arise for shipment of orders, returns, re-shipment etc. and any other fees such as tax and handling fee etc.
|
10 |
If the consumer selects SAL Small Packet or ePacket Light for shipment of their order, they are to take full responsibility for any damages or losses to the package during delivery.
We will not be held responsible for any damages or losses caused during shipment, and by selecting or requesting SAL Small Packet or ePacket Light for shipment of their order, the consumer is considered to have understood and agreed with this risk.

If the shipping method which the consumer selected is unavailable for their order, due to their order exceeding the size/weight limitation of that shipping method etc., we may change the shipping method to a method that allows shipment of said order without notice to the consumer, and the consumer is to have understood and agreed with this possibility of change in shipping method in advance.

|
|
Article 7: Reservation of product |
1 |
Consumers are able to reserve products to be purchased from us prior to the product's release date.
|
2 |
Shipping cost and availability of certain shipping options for reserved products will not be known until the product comes into stock, due to size/weight information being unavailable until the product comes into stock.
|
3 |
For products before release, we will obtain the quantity equivalent to the number of reservation we had received to the best of our abilities. However, we will make no guarantee that we can secure the said quantity of the product.
|
4 |
Consumers are able to reserve multiple products in one transaction. Further, consumers are able to select the shipping arrangement from either the "Monthly Shipment per Order Number" or "Ship on Release" options.
|
5 |
If the consumer reserves multiple products and selects "Ship on Release", we will process shipment of each product as they come into stock. If the consumer reserved products that have different release dates, we will also ship the products as they come into stock. However, if the release date falls on the same date, we may combine the shipment where we judge appropriate.
|
6 |
For consumers who selected "monthly shipment per order number" as the shipping arrangement option of their reservation, and also have multiple products reserved which are scheduled to be released in the same month with a single order number, we will ship those products together in a single package.
If the release date of the reserved product are changed and does not come into stock within the same month, products that comes into stock first will be held until the end of that month, along with other products that comes into stock during this time which have the same order number, and the products that are available at the beginning of the following month will be processed for shipment together.
For orders consisting of already released items and reservations, these items cannot be combined for shipment even if they have the same order number.
Only reservations with the same order number can be combined for shipment. Reservations with different order number cannot be combined for a single shipment. If it is necessary to have shipment of products with different order numbers to be combined, the consumer must use the "Order Recombination" function available from their account page.
However, we may combine orders where we find appropriate, if products a consumer had reserved are stocked on the same day.

|
Article 8: Combined shipment and Order Recombination |

For consumers who order multiple reserved or already released items, we will ship the products in a single shipment, as long as the consumer processed order recombination.
|
2 |
Members of this site are able to recombine their reserved products from different transactions to merge them into a single package.
However, members must understand and agree in advance that products will be shipped separately if the release date is changed to a different month, or if the package exceeds the size/weight limitation of that method.
|
3 |
As an exception, we may decide to combine orders for shipment even if the consumer had not processed order recombination, if there are ordered or reserved products that comes into stock on the same day and the timing of order processing matches, and if we deem it appropriate to combine them.
However, this does not guarantee combined shipment of items that are released on the same date, as this depends on the timing of the day the product comes into stock.

If the sales price is changed after confirmation of the order, the new sales price will be applied if order recombination is processed for that order.
|
|
|
|
|
Article 9: Product and Shipping Problems |
1 |
We will not accept any product returns or refund etc. which are due to the convenience of the consumer, all sales are final. We will only accept return of product in cases of shipment error or product defects that we confirmed and acknowledge as a defect.
|
2 |
If a consumer receives a product different to what they had ordered, they must contact us through the provided form, and follow our instructions.
|
3 |
If we judge the problem in the above clause to be color difference or defect that are within the margin of expected difference described in the 5th clause of Article 3, we will not consider the product to be defected, thus the first clause of this article applies.
|
4 |
If there is damage, defect, or missing parts etc. to the product at arrival before being opened, the consumer must contact us through the provided form for problems with products.
|
5 |
If there are any traces of damages to the container of their order etc. such as dent, tear or hole on the cardboard shipping box etc., and the product damage is judged to be caused during shipment, the consumer must report to us the possibility of shipment damage, and must follow our instructions based on our judgment. Further, the consumer must contact us through the provided form for problems with products.

Claim for the damaged product, defect or missing parts etc., stated in this article must be reported within 7 days counting from the date of acceptance of product, through the form we provide. Further, we will be able to regard the consumer to have checked and confirmed their received product within said 7 day confirmation period.
|

|
|
|
Article 10: Cancellation of Purchase Contract |

Consumer may apply for cancellation of their ordered or reserved product by using the "Cancel" button corresponding to the item that the consumer wish to cancel, listed on the Order History screen in the consumer's Hobby Search account page for the duration the "Cancel" button is available (hereinafter referred to as "cancellation period").
However, if the "Cancel" button is not available in the order history page for the item the consumer wish to cancel, the cancellation period for that order had either already ended, or there is message on the product page that specifies that the product "Cannot be cancelled" and the item cannot be cancelled to begin with.

We will not accept any cancellations of order or reservation by the consumer after the cancellation period ends.
However, if any of the following applies and we are in agreement with the consumer in regard to the cancellation, we will make exceptions.
|
|
(1) |
For reserved products, if there is unavoidable reason in which cancellation is necessary, and if the consumer contacted us by email requesting cancellation before the product comes into stock.
|
|
(2) |
For already released product, if the consumer contacted us by email before the start of the business hour corresponding to the times specified below.
|
|
|

Orders placed between 0:00AM ~ 08:30AM
Until 8:30AM of the same day (or the following operating day if the order is placed on a non-operating day).
|
|
|
- |
Orders placed between 8:31AM ~ 23:59PM
Until 8:30AM of the following business day.
|
|
(3) |
If the consumer selected "notify of stockout by e-mail" when applying for purchase, and there was a notice of stock shortage for a part of their order.
|
|
(4) |
If the retail price of the product greatly differs, in Japanese Yen, from the moment the reservation had been placed to the moment the product comes into stock. Changes of cost due to currency conversion rate will not be applicable to this clause.
|
|
(5) |
Otherwise, if there is a reason in which we judge as a special circumstance.
|
|
(6) |
We may choose to charge cancellation fee, restrict the payment method available for the consumer, and/or discontinue our business with the consumer etc. for any cancellation outside the cancellation period.
|

We may choose to charge cancellation fee, restrict the payment method available for the consumer, and/or discontinue our business with the consumer etc. for any cancellation outside the cancellation period, including any cases specified in the preceding clause.
|
4 |
We CANNOT accept cancellations for any product marked "This item cannot be cancelled" on their product page.
|
5 |
We CANNOT accept cancellations for reason related to shipping cost or change of shipping methods.
|
6 |
The consumer must understand and agree in advance that we hold the right to terminate the purchase contract, if a product is short stocked, unable to be stocked or restocked, or the release of the product is cancelled.
|
7 |
We will also be able to cancel part of the said purchase contract if the consumer ordered multiple products and a part of the ordered products are either short stocked, unable to restock or the release of the product is cancelled.
|
8 |
We hold the right to terminate the purchase contract without advance notice, if any of the following situations are applicable:
|
|
(1) |
If the consumer does not correspond to the first clause of the Article 3.
|
|
(2) |
If the consumer does not follow our instruction regarding processing of payments.
|
|
(3) |
If the consumer denied acceptance of the ordered product.
|
|
(4) |
If the consumer cancel or return product by means we do not specify.
|
|
(5) |
If the consumer denies payment or acceptance of products that are marked "This item cannot be cancelled".
|
|
(6) |
If the consumer declared false information regarding the use of this service.
|
|
(7) |
If the consumer used a credit card or other means of payment that does not belong to them, or is suspected of this.
|
|
(8) |
If the consumer had denied payment or acceptance of product from other transactions.
|
|
(9) |
If the shipping address or other information are obviously inadequate, and we are unable to communicate with the corresponding consumer within 7 days from the date the purchase contract was agreed upon.
|
|
(10) |
If the consumer violated this agreement, any other terms of service or guidelines specified on this site.
|
|
(11) |
Otherwise, if there is a reason that may possibly cause difficulties in the fulfillment of the purchase contract.
|

We hold the right to execute any of the procedures specified in Article 14 of the Membership Agreement to the consumer that applies to any points specified in the preceding clause.

Article 11: Principle of Personal Responsibility |

Consumers are to use this service entirely at their own responsibility.
|

Consumer are obliged to check and confirm the product contents, product price, quantity, contents of transaction as well as method of operation for equipment etc.
Further, consumer must bear all responsibility caused by the negligence of said confirmation.

Consumer must enable cookie and Java Script when using this service.
|
4 |
We will not be held responsible for any loss of Hobby Search Points or Hobby Search Points not being applied to the consumer's order etc. if the consumer failed to fulfill the duty specified in the preceding clause.

|
Article 12: Use of the Personal Information |

We will use and manage the personal information of the consumer or user of this site (hereinafter referred to as "user") in accordance with the privacy policy of this site. However, we will not guarantee that we can completely prevent leakage, erasure, or alternation by a third party etc. of the personal information.

The user must understand we may send information to users regarding any products or services we provide, using private or preference information collected from the user, and the user is to agree with the use of information in advance.

Article 13: Means of Notification |

We will regard the member to have agreed with the notification without objection, if said member had failed to receive our notification due to mistype or error of registered email address, neglected update of their email address or any other reasons caused by the intention or negligence of said member.

|
|
Article 14: Force Majeure (Exemption for extraordinary circumstances) |

Neither we, nor the consumer will be responsible for any delay or inability to fulfill the Sales Agreement due to an act of God, conflagration, revolution, war, or riot etc.
|
2 |
The section of the Sales Agreement which becomes delayed or impossible to fulfill due to the cause in preceding clause, is to be regarded annulled, and both parties (Hobby Search and consumers) are to have agreed to this in advance.
|
|
|
|
|
Article 15: Compensation for Damage |
1 |
Consumers are obliged to compensate in full, any damage to us or to a third party caused by the violation of this Sales Agreement, and is to exempt us under any circumstances.
|
2 |
The maximum value of compensation to the consumer for defect or damage of product will not exceed the sales price of the said product.

Article 16: Relationship between Sales Agreement and other user Terms of Service of this site |

Each Terms of Service or guideline on this site compose a part of the Sales Agreement to supplement this. However, it will not be a case if said Terms of Services contradicts or causes a flaw to the Sales Agreement.

Article 18: Alteration of this Sales Agreement |

If there is alteration to be made to this Sales Agreement, we will make an announcement to the members at least 14 days prior to the change.
The announcement will be made by the procedure established on thirteenth article.

However, if the alteration of terms requires urgency, we will have the right to post the altered the Sales Agreement on this site and regard notification to be completed, regardless of the preceding clause, and consumers are to agree to this alteration in advance.

We are not to be held responsible for any damage or loss, caused directly or indirectly by the termination of each service in first clause of this article.

Article 7: Governing Law and Jurisdiction |

If a dispute occurs between us and the user regarding this Terms and Condition, each other Terms and Conditions, or guidelines on our site, both parties must consult with sincerity to resolve the dispute.

Any dispute which could not be resolved through consultation shall be submitted to the Tokyo District Court in Tokyo, Japan as the Court of first instance.
